Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Cool Or Cruel app ("App") or visiting our website, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or website. These Terms constitute a legally binding agreement between you and Decisions Made Easy GmbH ("we", "us", or "our").

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. User Accounts

You may use certain features of the App without registering. To access additional features such as viewing your ratings history, using the chat, or purchasing credits, you must create an account.

• You must provide accurate and complete information when registering.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at cool-or-cruel@pjs.de if you suspect any unauthorized use of your account.
• Accounts are personal and may not be transferred to another person.

3. Content Guidelines — Zero Tolerance Policy

Cool Or Cruel operates a strict zero-tolerance policy for objectionable content. By using the App, you agree that you will never upload, submit, share, or otherwise make available any content that:

• Contains nudity, sexual content, or pornography of any kind
• Depicts or promotes graphic violence, gore, or self-harm
• Constitutes hate speech, discrimination, or content that degrades individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
• Harasses, bullies, threatens, or intimidates any individual
• Depicts, exploits, or endangers minors in any way — including but not limited to content of a sexual nature involving persons under 18
• Is illegal under applicable law or promotes illegal activity
• Infringes on the intellectual property rights of any third party
• Contains spam, malware, or deceptive content
• Violates the privacy of any third party (e.g., posting photos of others without their consent)

Violations of this policy will result in immediate content removal and may result in permanent account termination. We cooperate fully with law enforcement authorities where required.

4. User-Generated Content

You retain ownership of the photos and other content you upload to the App ("User Content"). By submitting User Content, you grant Decisions Made Easy GmbH a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of operating and providing the App's features.

You represent and warrant that:

• You own or have the necessary rights to the content you upload.
• Your content does not violate these Terms or any applicable law.
• You have obtained consent from any identifiable individuals depicted in your photos.

This license terminates when you delete your content or close your account, subject to any retention obligations required by law.

5. Content Moderation

We review all photos submitted to the App before they are published. We reserve the right, at our sole discretion, to remove any content that violates these Terms or that we find objectionable for any reason, without prior notice.

Content moderation is performed by automated systems and human reviewers. Despite our efforts, we do not guarantee that all violating content will be identified and removed immediately. If you encounter objectionable content, please use the in-app reporting function described below.

6. Reporting & Blocking

We provide tools within the App to report content or other users that you believe violate these Terms.

• Reporting: Use the in-app report function to flag objectionable content or accounts. You may also contact us directly at cool-or-cruel@pjs.de.
• Blocking: You can block other users to prevent them from interacting with you within the App.
• Response time: We will review all reports and take appropriate action within 24 hours of receipt.

Reports are confidential. We do not disclose the identity of users who submit reports.

7. Account Termination

We may suspend or permanently terminate your account at our sole discretion, without prior notice, if we determine that you have:

• Violated any provision of these Terms
• Uploaded content prohibited under Section 3
• Engaged in harassment, abuse, or fraudulent activity
• Created multiple accounts to circumvent a previous suspension or ban

Upon termination, your right to use the App ceases immediately. Any unused credits are forfeited upon termination for cause. You may request account deletion at any time by contacting us at cool-or-cruel@pjs.de.

8. Credits & In-App Purchases

The App offers virtual credits ("Credits") that can be purchased through Apple's in-app purchase system. Credits are used to access certain premium features such as sending chat messages.

• All purchases are processed by Apple and are subject to Apple's terms and conditions.
• Credits are non-refundable and have no monetary value outside the App.
• Credits cannot be transferred between accounts or exchanged for cash.
• We reserve the right to modify, discontinue, or change the pricing of Credits at any time.
• Unused Credits may be forfeited if your account is terminated for a violation of these Terms.

If you believe you have been charged in error, please contact Apple Support directly, as all billing is managed by Apple.

9. Disclaimer

The App and all content and features are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the actions of other users or for any User Content submitted through the App.

To the maximum extent permitted by applicable law, Decisions Made Easy GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. We may also notify you via in-app notification or email where appropriate.

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
